Terms and Conditions

These Terms and Conditions (“Terms”) set out the agreement between Rubi.Agency (“we”, “our”, “us”) and the client (“you”, “your”) for website design and related services. By engaging our services, you agree to these Terms.

1. Our Services

Rubi.Agency provides website design, development, and related creative services including content writing, photography, and website maintenance. Each project is carried out as agreed in writing between both parties.

2. Payment Terms

2.1 Standard Payment
For all website projects, a 50% deposit is required before any work begins. The remaining 50% balance is due upon completion of the website and before the site goes live.

2.2 Pay in 4 Option
If you choose to pay in instalments, the first payment must be made before work starts, with the remaining three payments taken every 30 days thereafter.

2.3 Non-Payment
If payment is not received on time, work may be paused until payment is made. We reserve the right to withhold website files, access, or delivery until all outstanding amounts have been paid in full.

2.4 No Refunds
All payments are non-refundable, including deposits and staged payments. By approving your project and making payment, you confirm that you wish to proceed under these terms.

3. Client Responsibilities

To ensure smooth delivery, you agree to:

• Provide all required content, images, and information needed to complete the project.

• Review and approve work in a timely manner.

• Respond to messages or feedback requests promptly.

Failure to supply requested materials or feedback may cause delays in the agreed timeline. We are not responsible for missed deadlines where delays are caused by late communication, missing information, or approvals from your side.

4. Timelines and Delivery

We aim to deliver websites within the agreed timeframe, typically within one week for Starter and Standard packages, and one to two weeks for Premium packages.

Timelines may vary if:

• Content or assets are not provided on time

• Additional revisions are requested

• There are changes to the original brief

We’ll always communicate clearly if delays occur.

5. Revisions

Each project includes one round of revisions after the first design is delivered. This allows you to request small layout, image, or copy adjustments.

Any further revisions or major design changes outside the agreed scope will be charged at an additional rate, which will be agreed before continuing.

6. Approval and Launch

Once your website design is approved and the final balance is paid, the website will be made live.

7. Maintenance and Updates

If you’ve included ongoing maintenance, updates will be carried out as agreed. If not, any future changes or fixes will be quoted separately.

8. Intellectual Property

All design, code, and content created by Rubi.Agency remain our property until full payment is received. Once paid in full, ownership of the final website design and written content transfers to you. We may use screenshots or visuals of the completed website in our portfolio or marketing materials.

9. Website Hosting and Third Parties

If hosting, domains, or email services are arranged through third parties, Rubi.Agency is not responsible for outages, performance issues, or changes made by those providers.

10. Liability

We take care to deliver a secure, well-built website. However, we cannot guarantee uninterrupted operation or absolute protection against third-party attacks or errors. Rubi.Agency will not be held liable for any loss of business, data, or revenue resulting from website downtime, misuse, or unauthorised access.

11. Governing Law

These Terms are governed by and interpreted in accordance with the laws of England and Wales. Any disputes shall be handled under the jurisdiction of the courts of England and Wales.
